In collaboration with The Seattle Times, Big Local News is providing full-text nursing home deficiencies from Centers for Medicare & Medicaid Services (CMS). These files contain the full narrative details of each nursing home deficiency cited regulators. The files include deficiencies from Standard Surveys (routine inspections) and from Complaint Surveys. Complete data begins January 2011 (although some earlier inspections do show up). Individual states are provides as CSV files. A very large (4.5GB) national file is also provided as a zipped archive. New data will be updated on a monthly basis. For additional documentation, please see the README.

The current facility policy had the potential to result in the medical record not being produced timely and for excessive charges when obtaining copies of the record. This practice had the potential to affect any resident/responsible party who exercised the right to obtain copies of the medical record. Facility Census: 81. Findings include: a) Review of the facility's policy titled Request for Medical Records, last reviewed 2013, revealed in section 6, . the documents should be produced within five (5) days of receipt of the notification that the request for a medical record is valid. Section 7 provided instructions for the steps of this process. It specified in 7.b In WV, the cost of production of the medical record is as follows: $10.00 search fee plus reasonable expenses, provided that the total charge does not exceed $0.75 per page for copying of records already reduced to written form. The Legislative Rules West Virginia Division of Health Title 64, Series 13 Nursing Home Licensure Rule specifies: -- Regulation 4.4.c: A resident may purchase, at a cost not to exceed twenty-five cents ($0.25) per page, photocopies of the records or any portions of them, upon oral or written request to the nursing home. -- Regulation 4.4.c.1: The nursing home will provide the photocopies materials to the resident within two (2) working days of the request. The administrator (Employee #59) was interviewed on 10/08/14 at 3:00 p.m. Employee #59 verified the policy and procedure of this facility was not in compliance with the state regulations specified in the Nursing Home Licensure Rule. 2017-10-01
